We use your personal data to align our online and in store services with your preferences, to provide you with purchases and services, to deal with your requests, to contact you regarding tailored products and services which may be of interest to you, to provide prize draws or competitions, or to carry out relevant administrative services. We have a registered protected Motivational Queen trademark and we respectfully ask for a cease and desist on anyone or any company replicating our mark.

CONTRACT

You may place an order to purchase a Product advertised for sale on the Site by following the onscreen prompts after clicking on the item you are interested in. You will have an opportunity to check and correct any input errors in your order up until the point at which you submit your order by clicking the payment page

Once you have submitted an order, you will receive an e-mail from us of acknowledgment. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the “Dispatch Confirmation”). The contract between us will only be formed when we send you the Dispatch Confirmation for the relevant Product.

The contract will relate only to those Products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the dispatch of such Products has been confirmed in a separate Dispatch Confirmation.

We may choose not to accept your order for any reason and we will not be liable to you or to anyone else in those circumstances.

We may be unable to process your order if:

The Product you ordered is out of stock or discontinued;

OR

There is a problem with authorisation of your method of payment.

Clothing fit for royalty. Please read the below information about caring for the clothing you purchase from us. We accept no responsibility if clothing is damaged due to your negligence handling.

STOCK AVAILABILITY

We do try to ensure that we have good stock availability of all products. However, some goods may sell faster than we predict. If the item you have ordered is not in stock, we will do our best to get it for you as quickly as possible. If we cannot get the item we will contact you by email with a estimated date and give you the option to cancel if it is more than 10 working days.

CONFORMITY

We warrant to you that any Product purchased from us through our site will, on delivery, conform in all material respects with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.

Every care has been taken to ensure that the descriptions and specifications of our products on this web site are correct. However, whilst the colour reproduction is an extremely close representation, a slight variation in the actual goods can occur

The contract between you and us is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

UNFORSEEABLE CIRCUMSTANCES

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control. Our performance under any Contract is deemed to be suspended for the period that the event outside our control continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the event to a close or to find a solution by which our obligations under the Contract may be performed despite the event. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations that is caused by events outside our reasonable control.

We have no control over any delays royal mail may experience and as such would endeavour to ensure your delivery arrives once they have rectified any unforeseeable circumstances.

In the event our suppliers experience issues with fulfilling the orders, we will try and keep the effects on you to a minimum but this may result in delays of receiving your products which we hold no responsibility.

LIABILITY

We are under a legal duty to supply Products that are in conformity with the contract. We accept no liability for any loss which is not reasonably foreseeable or for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses).

We accept no liability for any persons injuring themselves using any items in the way they are not intended. It is your responsibility to ensure the person using any products has no allergies preventing their use. If the intended recipient has any medical conditions, please check with your health provider before use.

We each acknowledge that, in entering into a Contract, neither of us relies on any representation or warranty (whether made innocently or negligently).

OUR RIGHT TO AMEND TERMS AND CONDITIONS

We have the right to revise and amend these terms and conditions at anytime. You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the order confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the products).

LEGAL  

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the non-exclusive jurisdiction of the courts of England and Wales.

We accept no responsibility for damages resulting from use of any of our products.

THIRD PARTY RIGHTS

A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

DELIVERY INFORMATION

Please note that due to the current climate with COVID you may experience a delay in shipping. However we have made steps to keep this to a minimum.

UK AND WORLDWIDE SHIPPING

Delivery of the gift sets will take between 3-8 Working Days. Delivery of all other items will take on average between 5-10 working days.

TRACKING

Most of our deliveries will need to be signed for. However in the event a signature is not required for delivery and if there is no one available to take delivery our carriers may attempt to leave it with a neighbour or in a safe, secure location. A card may be left to advise this to you, or to confirm that the parcel has been returned to the local depot. You can then contact them to arrange collection or to schedule a new delivery date.

RISK and OWNERSHIP

Once delivered, the Products ordered will become your responsibility and, except in relation to Products that are damaged or faulty when delivered or have been incorrectly delivered, we will not accept any liability for their loss, damage or destruction after they have been delivered. Ownership of the Products will only pass to you on: delivery of the Products to you; or us receiving full payment of all sums due in respect of the Products.

OUR CANCELLATION, RETURNS AND REFUND POLICY

Except in relation to the Products specified in the next paragraph, you may cancel your order (or any part of it) at any stage before the Products are dispatched to you by contacting our Customer Services team at [email protected]

You may not cancel your order if the Products are (i) personalised for you; or (ii) perishable items (e.g. food) unless such Products were damaged or faulty when delivered to you or have been incorrectly delivered. Where you decide to cancel an order after we have dispatched the Products, you will be under a duty to return them to us, at your own risk. We will not be responsible for any loss or damage to the Products in transit. All such Products should be returned within 10 days after the Products have been delivered to you. Until such time as they are returned, you must retain possession of the Products and take reasonable care of them. You should return the Products to us unused and in the same condition in which you received them together with the original Product packaging, by one of the means set out in our Returns Procedure.

After you cancel your order and return the Products, any sum debited by us to your credit/debit card/PayPal will be refunded in full (including the cost of delivery if you paid for delivery). We may make a deduction from the reimbursement for loss in value of any Products if the loss is a result of unnecessary handling by you. We will notify you of your refund via e-mail within a reasonable period of time. We will usually refund any money received from you using the same method originally used by you to pay for your purchase except PayPal returns in store. Refunds for Products purchased as gifts can only be given to the credit/debit card of the person who placed the order. We will process the refund due to you as soon as possible and, in any case, within the earlier of (a) 14 days of the day we receive back the Products from you; (b) 14 days of the day you provide us with evidence that you have returned the Products; or (c) where no Products were dispatched 14 days of the day you provide your notice to cancel the order.

If any Product you purchase is damaged, faulty or incorrect, when delivered to you we may offer an exchange or refund as appropriate, in accordance with your legal rights. If you believe a Product is faulty, you should return the Product to us in accordance with the Returns Procedure. If you have any questions regarding returns, please Contact us.

Our policy on cancellations, returns and refunds does not affect your statutory legal rights under the Consumer Rights Act 2015 or the Consumer Contracts Regulations 2013.
